Required Notices for Colorado Military Academy
At Colorado Military Academy, we are committed to transparency and compliance with all state and federal regulations. Below, you will find important notices and disclosures required for public charter schools in Colorado.
Colorado Military Academy does not discriminate on the basis of disability, race, creed, color, sex, sexual orientation, gender identity, gender expression, national origin, language, religion, ancestry, need for special education services, or any other protected class. Colorado Military Academy serves students with disabilities and English Learners and provides services to students as required by state and federal law.
In most cases, the services required by a student with disabilities can be provided at Colorado Military Academy. In some cases, a student’s individual needs require that they be placed in a different program or location as determined by an IEP or Section 504 team.
Like all charter schools, Colorado Military Academy is a public school. Colorado Military Academy serves students with disabilities and English Learners and provides services to students as required by state and federal law. Charter schools are subject to all federal and state laws and constitutional provisions prohibiting discrimination on the basis of disability, race, creed, color, sex, sexual orientation, gender identity, gender expression, national origin, language, religion, ancestry, need for special education services, or any other protected class. Laws applicable to students with disabilities include the Individuals with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act of 1973 (Section 504), and the Americans with Disabilities Act (ADA).
Under IDEA, students with disabilities are entitled to a Free and Appropriate Public Education (FAPE) in the Least Restrictive Environment (LRE). The services a student requires under IDEA are described in an Individualized Education Plan (IEP). Under Colorado law, the provision of FAPE and specific services required by a student’s IEP are a joint responsibility of the charter school and the local educational agency, most often the authorizing school district. Applicants to Colorado Military Academy are not required to identify whether the applicant has an IEP, and admission to the school is made without considering a student’s disability. After a student with an IEP is initially admitted to the school, an IEP team meeting may be required to determine whether this school is an appropriate placement for the student based on their needs.
In most cases, the services required by a student with disabilities can be provided at Colorado Military Academy. In some cases, a student’s individual needs require that they be placed in a different program or location as determined by an IEP or Section 504 team.
In compliance with Titles VI & VII of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, the Age Discrimination in Employment Act of 1967, the Americans with Disabilities Act, the Genetic Information Nondiscrimination Act of 2008, and Colorado law, Colorado Military Academy does not unlawfully discriminate against otherwise qualified students, employees, applicants for employment, or members of the public on the basis of disability, race, creed, color, sex, sexual orientation, gender identity, gender expression, marital status, national origin, religion, ancestry, family composition, or need for special education services. Discrimination against employees and applicants for employment based on age, genetic information, and conditions related to pregnancy or childbirth is also prohibited in accordance with state and/or federal law. Harassment, if it rises to the level described in state law, is a prohibited form of discrimination.
The Board has adopted policies to handle discrimination complaints in alignment with federal and state law. Board-approved policies can be found here:
